A fiduciary is person that the other party can trust. He or she is obligated to act in the other party’s best interests. In a buyers’ agent home buyer relationship, the agent works on behalf of the buyer and must hold the buyer’s interests above his/her own. It requires the highest standard of care and loyal treatment to the buyer.

As per the National Association of Realtors (NAR), fiduciary duties cover six distinct areas: 1) Accounting; 2) Reasonable Care; 3) Confidentiality; 4) Disclosure; 5) Obedience; and 6) Loyalty.
