Is Dual Agency Detrimental to Homebuyers?

Dual agency definition: Occurs when the same brokerage represents both the buyer and the seller under written agreement. This means that if you have a buyers agreement with a real estate agent and find a home you are interested in that is under the same broker that your agent works for, another agent or the same agent within the same office can represent the seller.

That doesn’t sound so bad does it? Written agreements are made, that sounds safe.

Think again. Dual agency can be detrimental to a buyer in certain cases. A company that allows dual agency may say they work as a dual agency but actually operate more closely to a single agency. In small offices, phone calls with the buyer discussing pricing and terms can be overheard or faxes accidentally seen. Unintentionally an agent may be talking about a buyer in the break room and be overheard by the sellers agent. This can give the sellers agent information that may benefit the seller.

Retirement home search with Buyer Broker

Our experience convinced us of the value of an exclusive buyer broker. By previewing properties, he made our search much more efficient, and once he found a waterfront property that we liked, he performed extensive research on local and state restrictions, environmental data, its history (back into the 1800s), etc.  Ultimately, this resulted in our having more accurate information about the property than even the selling broker or the owners had.  Our buyer broker’s services were invaluable and helped to relieve many of the stresses and complications inherent in purchasing a home, especially as we were buying out of state in an area that was new to us.  He even found us a local real estate attorney and a home inspector  His patience, diligence, and professionalism meant that we could negotiate and make our purchase with confidence, equipped with all the information we needed.  Overall, his personal attention to serving our needs and protecting our interests made for a most positive experience.

EBAs Go To Infinity….And Beyond!

Exclusive Buyer Agents are an amazing breed. They work only for the buyer. This gives them the value of having no conflict of interest with other listings in their office. I hear over and over again how happy home buyers are when we refer them to our Exclusive Buyer Agents.

Here is one example of just how far EBAs will go to assist the buyer in finding their perfect home. Penny from (now) Oregon writes:

Desperate times call for desperate measures, especially for home sellers in this real estate market. A recent Yahoo article talks about common fibs that home sellers are more frequently telling buyers in a desperate attempt to sell their homes.

The common fibs that are being reported by real estate professionals and state regulators are:

Tips To Find The Right Buyer’s Agent

We recently heard back from one of our buyers that we referred to an exclusive buyer’s agent in their area of interest.

The buyer thanked us for the broker’s contact information and for the set of interview questions that we provided to help her choose the right broker for her. She said the suggested interview questions allowed her to have a successful interview and to make a confident decision to work with the broker we suggested.

It is important to feel confident in your decision of the buyer’s agent you decide to work with because they will play a vital role in your home buying process.

Here are a couple tips to consider when you are looking for the right buyer’s agent:

1.)   Take your time – do not agree to work with the very first buyer’s agent you talk to

2.)   Ask the buyer’s agent if they offer a free consultation session

Confusion Over Types of Buyer Agents

I spoke to a man today that is looking to buy land in either Kansas or Oklahoma. We were able to give him contact information of an exclusive buyer agent office in Oklahoma.  However, we had no exclusive buyer agents in his preferred city in Kansas so we offered him a good alternative.

The gentleman did not realize there are different types of real estate agents until today during our phone conversation. Any licensed real estate agent can act as a designated agent on your behalf.  However,  exclusive buyer agents who work in EBA companies provide the highest form of buyer representation. The whole company specializes in working with buyers. They are 100 percent dedicated to buyers and do not spend any time trying to sell or market properties.  EBA offices have no contracts to get the highest price & best terms for sellers, as do traditional companies.
